Frequently Asked Questions...

 

How will you locate the debtor?

 

We have the resources to locate and skip trace the debtor, and often all the necessary information required to locate the debtor and their assetsare found on credit reports and various other reports.  We have a wide range of skip tracing tools that we utilize.

 

What kinds of assets can you seize?

 

We can seize bank accounts, garnish wages (Child Support cases only), rental deposits, personal property, till taps, commercial property, and non-exempt property.

 

What are your fees for this service?

 

Depending on what service you are requesting, our fees are based on a percentage of what is collected for you.  We pay for the skip tracing and filing fees up front, then deduct them from any amounts collected before taking our percentage.  We file a form with the courts to increase the judgment award amount of any fees we have incurred so that you will get an accurate percentage of the judgment awarded to you.

 

What if you can't find any assets belonging to the debtor?

 

If there are no assets available we will attempt to contact the debtor and negotiate monthly payments.  If we are not successful with securing a payment plan, we will continue to monitor the debtors credit reports and other sources for newly acquired assets and go after the assets.

 

How long will it take to collect my judgment?

 

No two cases are the same, but typically it can take from as little as 1-4 months to as long as 6 months or more depending on the circumstances.

 

How will we know what is going on with the case?

 

We will send a bimonthly statement of the current status.  Of course, you are always welcome to call our office for status of your judgment. 

 

So how do we get started?

 

We will send a packet of forms for you to review.  Once you are ready to move forward, you sign the forms and return them to our office.  We will begin working on your case by filing an Acknowledgment with the courts.  We will be in communication with you throughout the process.  Once we receive funds from the process a check will be issued to you, less our percentage and fees incurred.
